My Guantanamo Diary: The Detainees and the Stories They Told Me
Who exactly has America detained all these years at Guantanamo? The Worst of the Worst? Or the Wretched of the Earth?

Mahvish Khan is an American lawyer, born to immigrant Afghan parents in Michigan. Outraged that her country was illegally imprisoning people at Guantanamo, she volunteered to translate for the prisoners. She spoke their language, understood their customs, and brought them Starbucks chai, the closest available drink to the kind of tea they would drink at home. And they quickly befriended her, offering fatherly advice as well as a uniquely personal insight into their plight, and that of their families thousands of miles away.

For Mahvish Khan the experience was a validation of her Afghan heritage--as well as her American freedoms, which allowed her to intervene at Guantanamo purely out of her sense that it was the right thing to do. Mahvish Khan's story is a challenging, brave, and essential test of who she is--and who we are..

Poems from Guantanamo: The Detainees Speak
Since 2002, at least 775 men have been held in the U.S. detention center at Guantánamo Bay, Cuba. According to Department of Defense data, fewer than half of them are accused of committing any hostile act against the United States or its allies. In hundreds of cases, even the circumstances of their initial detainment are questionable.

This collection gives voice to the men held at Guantánamo. Available only because of the tireless efforts of pro bono attorneys who submitted each line to Pentagon scrutiny, Poems from Guantánamo brings together twenty-two poems by seventeen detainees, most still at Guantánamo, in legal limbo.

If, in the words of Audre Lorde, poetry “forms the quality of light within which we predicate our hopes and dreams toward survival and change,” these verses—some originally written in toothpaste, others scratched onto foam drinking cups with pebbles and furtively handed to attorneys—are the most basic form of the art.

Death Poem by Jumah al Dossari
Take my blood.
Take my death shroud and
The remnants of my body.
Take photographs of my corpse at the grave, lonely.

Send them to the world,
To the judges and
To the people of conscience,
Send them to the principled men and the fair-minded.

And let them bear the guilty burden before the world,
Of this innocent soul.
Let them bear the burden before their children and before history,
Of this wasted, sinless soul,
Of this soul which has suffered at the hands of the "protectors or peace."

Jumah al Dossari is a thirty-three-year old Bahraini who has been held at Guantanamo Bay for more than five years. He has been in solitary confinement since the end of 2003 and, according to the U.S. military, has tried to kill himself twelve times while in custody.

Bush, the Detainees, and the Constitution: The Battle over Presidential Power in the War on Terror
The infamous detainees of Guantanamo, garbed in their bright orange prison jumpsuits, have come to symbolize a host of controversial policies and powers claimed by President George W. Bush in the so-called war on terror. Designated as "enemy combatants," a vaguely defined and previously unrecognized category in the international laws of war, they have been at the center of a legal firestorm challenging the Bush administration's conduct of the war.

Howard Ball, one of our nation's leading constitutional authorities, takes a close look at the White House's defense of its detainee program (what some have called an "American gulag"), the court actions used to challenge that enormous expansion of unchecked presidential power, and the potential threats to American democracy should those actions ultimately fail. Focusing on the Enemy Combatants Cases of 2004 and 2006--including Rasul v. Bush, Hamdi v. Bush, Rumsfeld v. Padilla, and Hamdan v. Rumsfeld--Ball examines competing legal arguments pitting the detainees' fundamental human rights (including habeas corpus) against Bush's proclamation that he alone has the authority to decide their fate, as well as efforts by the Court and Congress to reclaim their own authority in such matters.

Ball describes how the administration repeatedly found ways to evade both the letter and spirit of the Court's decisions through new legislation, presidential signing statements, and even redefinition of the status of the detainees. He also examines the official context of the cases--including the two Congressional Authorizations for the Use of Military Force, the "Patriot Act," and the NSA's warrantless wiretapping program--as well as other factors such as presidential claims to "state secrets privilege," the torture controversy, and the impact of the 2006 elections.

Ball reminds us once again that, in a time of war, there will always be a great tension between the need for security and the constitutional protection of due process. Ultimately, he tells a troubling story about the relationship between absolute presidential power and the principles of representative government, one that thoughtful readers cannot afford to ignore..

America's Disappeared: Secret Imprisonment, Detainees, and the "War on Terror" (Open Media Book)

September 11, 2001, sparked a firestorm of racial profiling, detentions and deportations by the United States government so grievous as to evoke the shameful internment of Japanese Americans of more than half a century past. Thousands have been imprisoned without either trial or any kind of judicial hearing: detained, often indefinitely, solely on the say-so of the executive. Yet knowledge of the particular circumstances and incidents of the detentions remains dim.

America's Disappeared: Secret Imprisonment Detainees and the "War on Terror" brings together, for the first time, detainees' own testimonies with a comprehensive framework for understanding the issues by leading constitutional scholars working for their release. Going beyond the prevailing accounts to a detailed exploration of detention-the forms currently in use, and the conditions of each-the authors authoritatively refute its alleged justifications, boldly exploring its human costs.

Beginning with a catalogue of dragnet schemes--voluntary interviews, NSEERs, the targeting of foreign students-America's Disappeared proceeds to document the blunt reality of this program of detention, presenting detainees' chilling accounts of solitary confinement, isolation, and physical and mental abuse. Turning to a history of American detention policy, the book surveys U.S. opposition to these illegal practices undertaken outside our borders and warns of the dangerous precedent set by this homegrown example.

Michael Ratner is president of the Center for Constitutional Rights. He has led several cases representing detainees held at Camp X-Ray in Cuba; Rachel Meeropol is the Center's equal justice work fellow; Barbara Olshansky is the assistant legal director of the Center for Constitutional Rights and author of Secret Trials and Executions; Steven MacPherson Watt is human rights fellow at the Center.

Command’s Responsibility: Detainee Deaths in U.S. Custody in Iraq and Afghanistan
Human Rights First’s new report,"Command’s Responsibility: Deaths in U.S. Custody in Iraq and Afghanistan," provides the first comprehensive accounting of the U.S. government’s handling of the nearly 100 cases of detainees who have died in U.S. custody since 2002. In its report, Human Rights First looked at some of the most troubling abuse cases, including up to 12 cases in which people were tortured to death. The report found that flawed investigations and a lack of punishment, especially at the highest levels, has lead to a culture of impunity on abuse.

Despite the number of deaths of prisoners in U.S. custody, as of February 2006, only 12 detainee deaths have resulted in any kind of punishment for any U.S. official, military or civilian. The report finds that often the more serious the case – particularly those involving people tortured to death – the less severe the punishment; the highest sentence in a torture-related death is five months in prison. Based on this, Human Rights First concluded that a gap exists between policies leadership says it respects on paper, and behavior it actually tolerates in practice..
